Before using the services, you shall read and comply with the "KiTalk User Service Agreement" (hereinafter referred to as the "Agreement"), KiTalk Platform Self-Discipline Convention", and the "Privacy Policy Terms". Please read carefully and fully understand the contents of each clause, especially the clauses on exemption or limitation of liability, jurisdiction and applicable law, and any separate agreements for activating or using certain services. Limitation and disclaimer clauses may be highlighted in bold or underlined to draw your attention.
When you fill in information on the registration page, read and agree to this Agreement and complete all registration procedures, or when you actually use the Services in other ways permitted by Joyplay Entertainment Technology Company Limited. (hereinafter referred to as KiTalk), it means that you have fully read, understood, and accepted the provisions of this Agreement. At that time, you may not claim that this Agreement is invalid or request its revocation on the grounds that you have not read the content of this Agreement or have not obtained KiTalk's answers to your inquiries.
If you are under 18 years of age, please read this Agreement in the presence of your legal guardian, paying special attention to the terms for minors.
This Agreement is concluded between the user who uses KiTalk services through the KiTalk mobile client software or other means and KiTalk.
1. The content of this Agreement includes the main body of this Agreement and all privacy policies, various policies, rules, statements, notices, warnings, prompts, and explanations that have been published or may be published in the future (hereinafter referred to as the "Rules"). The aforementioned Rules are an integral part of this Agreement and have the same legal effect as the main body of the Agreement.
2. KiTalk has the right to formulate and modify this Agreement and related Rules from time to time as needed. Once the changed agreement and rules are published, they will immediately replace the original agreement and rules and take effect automatically. If you do not agree to the relevant changes, you should immediately stop using KiTalk services. If you continue to use KiTalk services or engage in any website activities, it means that you have accepted the revised agreement and rules.
1. KiTalk provides service software in various forms such as iOS version and Android version for mobile clients (subject to what KiTalk provides). KiTalk will continuously enrich the terminals and forms for you to use the services. This Agreement automatically applies to your use of all versions of the software and services.
2. KiTalk grants you a non-exclusive license to use the KiTalk software. You may make one copy of the software solely for backup purposes. The backup copy must contain all copyright information contained in the original software. All other rights not expressly granted in this clause and other terms of this Agreement are reserved by KiTalk. You must obtain written permission from KiTalk separately to exercise these rights. KiTalk's failure to exercise any of the aforementioned rights does not constitute a waiver of that right.
3. The service content includes but is not limited to supporting technical functions such as contacts, sessions, unread message lists, and also provides users with functions including but not limited to convenient tools, information exchange with other software or hardware, payment, etc. These functional services may be optimized, modified, or temporarily suspended due to regular or irregular maintenance based on changes in user needs, differences in service versions, or the unilateral judgment of the service provider.
4. At the same time, KiTalk reserves the right to change, upgrade, modify, or transfer the service or any part thereof and its related functions and application software at any time at its sole discretion. You agree that KiTalk shall not be required to notify you of such actions and shall not be liable to you or any third party for any such actions.
1. You confirm that when you complete the registration process or actually use the services in other ways permitted by KiTalk, you shall be a natural person, legal person, or other organization with full civil capacity and capacity for civil conduct appropriate to the civil acts engaged in. If you do not have the aforementioned qualifications, please do not use the services. Otherwise, you and your guardian shall bear all consequences resulting therefrom, and KiTalk has the right to cancel (permanently freeze) your account and claim compensation from you and your guardian.
2. You shall submit true, accurate, complete, and up-to-date identity and other relevant information during registration. You understand and agree that you promise that the account name, avatar, and other information registered shall not contain illegal or undesirable information, impersonate others, register for others without permission, register or set up a KiTalk account in a way that may cause misidentification by other users, or use a username that may infringe upon the rights of others (including but not limited to suspected infringement of trademark rights, reputation rights, etc.). Otherwise, KiTalk has the right to refuse registration, stop services, and reclaim the KiTalk account, and any losses arising therefrom shall be borne by you.
3. You can use the mobile phone number you provide or confirm or other methods allowed by KiTalk as an account for registration, and promise that the registered account name, avatar, profile, and other information shall not contain illegal or undesirable information, impersonate others for registration, register for others without permission, register an account in a way that may cause misidentification by other users, or register with a username that may infringe upon the rights of others (including but not limited to suspected infringement of trademark rights, reputation rights, etc.). Otherwise, KiTalk has the right to refuse registration, stop services, and reclaim the account, and any losses arising therefrom shall be borne by you.
4. You understand and agree that the ownership of the KiTalk registered account belongs to KiTalk. After registration is completed, you only obtain the right to use the account. The right to use the KiTalk account belongs solely to the initial applicant and registrant and may not be transferred or provided to others in any way. Otherwise, KiTalk has the right to immediately reclaim the account without notice. You shall bear any losses caused by the clearing or loss of all data, information, etc. generated by your use of the services.
5. After you successfully register, KiTalk will confirm your identity based on your account and password. You shall properly keep your terminal, account, and password, and be fully responsible for all activities conducted using the account and password (including but not limited to clicking to agree or submit various rule agreements or purchase services online, sharing information or pictures, initiating voice calls, etc.). You promise to immediately notify KiTalk if your password or account is used without authorization or if any other security issue occurs. You agree and confirm that KiTalk shall not be liable for any direct or indirect loss or damage arising from the above circumstances. Unless required by law or judicial ruling and with the consent of KiTalk, your account and password may not be transferred, gifted, or inherited in any way (except for property rights and interests related to the account).
1. The user fully understands and agrees that KiTalk only provides a service platform, and you shall be responsible for all actions and results of using the services. Accordingly, you should understand that there are risks of illegal or inappropriate behavior (or information) from others when using KiTalk services. You shall make your own judgments and take actions, and bear the corresponding risks.
2. You shall bear the costs incurred by using the services, including but not limited to internet data fees, communication service fees, etc.
3. Unless otherwise stated, the services under this Agreement can only be used for non-commercial purposes. You promise not to copy, reproduce, sell, resell, or use any part of the service or the use or acquisition of the service for any commercial purposes including but not limited to advertising.
4. You understand and agree that KiTalk has always been committed to providing users with a civilized, healthy, and orderly network environment. You may not use KiTalk accounts or this software and services to produce, copy, publish, or disseminate content that interferes with the normal operation of KiTalk and infringes upon the legitimate rights and interests of other users or third parties, including but not limited to:
4.1 Publishing, transmitting, disseminating, or storing content prohibited by national laws and regulations:
(a) Opposing the basic principles established by the Constitution;
(b) Endangering national security, leaking state secrets, subverting state power, or undermining national unity;
(c) Damaging national honor and interests;
(d) Inciting ethnic hatred, ethnic discrimination, or undermining ethnic unity;
(e) Undermining national religious policies, promoting cults and feudal superstitions;
(f) Spreading rumors, disturbing social order, or undermining social stability;
(g) Spreading obscenity, pornography, gambling, violence, murder, terror, or inciting crime;
(h) Insulting or slandering others, infringing upon the legitimate rights of others;
(i) Containing false, fraudulent, harmful, coercive, infringing upon others' privacy, harassing, infringing, defamatory, vulgar, obscene, or other morally objectionable content;
(j) Inciting illegal assembly, association, procession, demonstration, or gathering to disturb social order;
(k) Acting in the name of illegal non-governmental organizations;
(l) Failing to comply with the "Interim Provisions on the Administration of Public Information Services of Instant Messaging Tools" and the "Seven Bottom Lines" requirements including compliance with laws and regulations, the socialist system, national interests, legitimate interests of citizens, public order, social morality, and information authenticity;
(m) Containing other content restricted or prohibited by Chinese laws, regulations, rules, ordinances, and any norms with legal effect;
4.2 Impersonating any person or institution, or falsely claiming or misrepresenting an association with any person or institution;
4.3 Forging titles or otherwise manipulating identification information to mislead others into believing that the content is transmitted by KiTalk or its affiliated companies;
4.4 Uploading, transmitting, or sharing any content known but not authorized to transmit due to any legal or contractual relationship or legal relationship (e.g., internal information, proprietary and confidential information known or disclosed due to employment relationships and confidentiality agreements);
4.5 Uploading, transmitting, or sharing content suspected of infringing upon the rights of others (including but not limited to intellectual property rights such as copyright, patent rights, trademark rights, trade secrets);
4.6 Stalking or otherwise harassing others, or sending a large amount of information to friends or other users through the services;
4.7 Uploading, transmitting, or sharing any advertisements, promotional information, promotional materials, "spam," "junk mail," "chain letters," "direct marketing," or any other form of solicitation materials; except for dedicated areas or functions intended for the aforementioned purposes;
4.8 Since this service is not designed for certain specific purposes, you may not use this service for important fields including but not limited to nuclear facilities, military purposes, medical facilities, transportation, and communications. KiTalk shall not bear legal liability for personal injury, property loss, and environmental damage caused by software or service failures leading to the failure of the above operations;
4.9 Engaging in any behavior beyond the normal purpose of internal or external information communication and exchange between friends or users;
4.10 For purposes beyond the normal purpose of internal or external information communication and exchange between friends or users (including but not limited to sending advertisements, spam, harassment, or illegal information), forming friend relationships with other users through any means such as adding oneself or inducing others to add (friend relationships include but are not limited to one-way and two-way friend relationships, the same below); sending a large amount of information to friends or other users through this service;
4.11 Publishing, transmitting, disseminating, or storing content that infringes upon the legitimate rights of others such as reputation rights, portrait rights, intellectual property rights, and trade secrets;
4.12 Involving the privacy, personal information, or data of others;
4.13 Other information that violates laws, regulations, policies, public order and good customs, social morality, or interferes with the normal operation of KiTalk and infringes upon the legitimate rights and interests of other users or third parties.
5. You promise not to engage in the following acts regarding this software and services:
5.1 Uploading, posting, emailing, or otherwise transmitting materials containing software viruses or other computer code, files, or programs designed to interfere with, destroy, or limit the functionality of any computer software, hardware, or communication equipment;
5.2 Interfering with or disrupting this service or the servers and networks connected to this service, or violating any regulations, procedures, policies, or norms regarding the networks connected to this service;
5.3 Modifying or forging instructions and data during software operation, adding, deleting, or changing the functions or operational effects of the software, or operating or disseminating to the public software or methods used for the above purposes, regardless of whether such acts are for commercial purposes;
5.4 Logging in or using the software and services through third-party software, plugins, add-ons, or systems not developed or authorized by KiTalk, or producing, publishing, or disseminating such tools;
5.5 Interfering with this software and its components, modules, data, etc., by yourself, authorizing others, or using third-party software.
6. You promise to strictly abide by this Agreement (including the Rules described in Article I of this Agreement) when using KiTalk services.
7. You agree and accept that KiTalk is not required to constantly monitor the materials and information you upload, transmit, or share, but KiTalk has the right to review and supervise your use of the services and take corresponding actions, including but not limited to deleting information, suspending or terminating services, and reporting to relevant authorities.
8. You promise not to use this service in any form to infringe upon the commercial interests of KiTalk or engage in any behavior that may cause damage or be detrimental to KiTalk.
9. You understand and agree that during the provision of KiTalk services, KiTalk, its affiliated companies, or authorized units and individuals have the right to place various commercial advertisements or other types of promotional information in various ways. At the same time, you agree to receive the above advertisements or promotional information via email or other means.
10. You fully understand and agree that you must be responsible for all actions under your registered account, including any content you publish and any consequences arising therefrom. You should judge the content you access while using the services and bear all risks arising from the use of the content, including risks arising from reliance on the correctness, completeness, or usefulness of the content. KiTalk cannot and will not be liable for any loss or damage you suffer due to the aforementioned risks.
11. If KiTalk discovers or receives reports from others that you have violated the terms of this Agreement, KiTalk has the right to delete or block the relevant content at any time without notice and take measures including but not limited to reclaiming accounts, restricting, suspending, or terminating your use of part or all of the services, and pursuing legal liabilities.
12. All parties are fully aware of the current situation that "the domestic e-commerce environment in China is not yet mature, and e-commerce legislation and credit systems are still imperfect," as well as the risks involved in conducting e-commerce business. All parties promise to take reasonable risk prevention measures to minimize risks. You agree and promise to comply with the following requirements:
12.1 During payment transactions, you shall strictly comply with the policies and regulations of the People's Bank of China regarding online banking and credit card transactions, and shall not engage in false transactions, illegal cash-out, money laundering, etc. You shall not directly or indirectly engage in illegal transactions such as online gambling, pornographic platforms, online lottery sales platforms, illegal foreign exchange and precious metal investment trading platforms, illegal securities and futures trading platforms, token issuance financing and virtual currency trading platforms, nor conduct asset management business online without approval from regulatory authorities or bulk commodity trading venues without provincial government approval. Otherwise, KiTalk has the right to terminate payment and settlement services for you.
12.2 You promise that the source of funds you recharge into the merchant account is legal and free of any ownership disputes. Otherwise, you shall bear all losses and legal liabilities resulting from violating the above Promise.
12.3 KiTalk has the right to conduct risk management on your payment business, continuously monitor and analyze transaction characteristics such as amount, number, type, time, frequency, payee, and payer, and improve suspicious transaction monitoring models. If KiTalk discovers abnormal situations such as transaction amounts, times, frequencies inconsistent with the business scope and scale of the special merchant, it has the right to take measures against you such as delaying fund settlement, setting receiving limits, suspending bank card transactions, and reclaiming acceptance terminals (closing online payment interfaces). At the same time, you agree that if KiTalk discovers or, after receiving reports from others, determines that your account is involved in or suspected of illegal or criminal activities including but not limited to fraud, theft, money laundering, gambling, or other violations of local policies and regulations during use, KiTalk has the right to take measures against the account such as restricting recharge and consumption, limiting the number of withdrawals (no more than one withdrawal per day), limiting withdrawal amounts (no more than 500 yuan per day), and disabling payment functions, and has the right to freeze or deduct account funds according to the instructions of state authorities.
12.4 You can set daily cumulative transfer limits and numbers between payment accounts and payment accounts, and between payment accounts and bank accounts on the KiTalk platform. Transfers exceeding the set limits and numbers will not be processed by KiTalk. KiTalk has the right to adjust your cumulative transfer limits and numbers based on your payment risks and KiTalk's own risk control needs. If you do not accept KiTalk's unilateral adjustment, either party may terminate this Agreement without liability to the other.
13. The information submitted during account registration is the basis for KiTalk to identify you. Please keep it safe. If your account is involved in or suspected of illegal or criminal activities including but not limited to fraud, theft, etc. during use, KiTalk has the right to take measures against the account such as banning the account or partially disabling functions for up to 180 days without notifying you.
14. You shall register an account through the official KiTalk client, comply with various registration and usage norms, use the software legally, and shall not copy, modify, add, delete, hook up, run, or create any derivative works from the data released into any terminal memory during the operation of this software, the interactive data between the client and server during software operation, and the system data necessary for the operation of this software, including but not limited to using plugins, add-ons, or third-party tools/services not authorized by KiTalk to access this software and related systems. If your above behavior causes abnormalities when using the software, including but not limited to personal information leakage, login abnormalities, theft of funds in the account, and any financial losses resulting therefrom, you shall bear them personally. At the same time, KiTalk will pursue the corresponding legal liabilities for your infringement/joint infringement through legal means.
1. Any free trial or free features and services of this service shall not be considered as KiTalk waiving the right to charge fees subsequently.
2. You shall pay for the internet fees and other communication and information fees charged by third parties that may arise from using this service.
1. When you make any form of commitment to KiTalk's affiliated companies and the relevant company confirms that you have breached that commitment, KiTalk has the right to immediately take restrictive measures against your account in accordance with the method agreed in your commitment, including but not limited to suspending or terminating the provision of services to you and publicizing your Breach of contract confirmed by the relevant company. You understand and agree that KiTalk is not required to verify the facts with you regarding the relevant confirmation or obtain your consent separately, and KiTalk shall not bear any liability to you for such restrictive measures or publicizing behavior.
2. Once you violate this Agreement or any other agreements entered into with KiTalk, KiTalk has the right to notify KiTalk's affiliated companies in any way to take restrictive measures against your rights and interests, including but not limited to requesting KiTalk's affiliated companies to suspend or terminate the provision of part or all of the services to you and publicizing your Breach of contract on any website operated or actually controlled by them.
1. KiTalk allows third-party applications to access the service platform. You can directly obtain third-party application services including but not limited to OA software from KiTalk. You understand and agree that KiTalk only acts as a platform provider. The relevant applications are provided independently by the third party. KiTalk does not assume any responsibility for your use of such applications.
2. You understand and agree that if adjustments, suspensions, or terminations of the service or part thereof by KiTalk affect third-party application services, KiTalk shall not bear any responsibility.
3. When you use KiTalk through third-party applications or services, KiTalk may call third-party systems or support your use or access through third parties. The results of use or access are provided by that third party.
1. You agree that, given the particularity of internet services, KiTalk has the right to suspend, terminate, or cause the suspension or termination of the service or any part thereof at any time; for the suspension or termination of free services, KiTalk is not required to notify you.
2. You understand and agree that KiTalk has the right to independently decide its business strategies. In the event of merger, division, acquisition, or asset transfer involving KiTalk, KiTalk may transfer relevant assets under this service to a third party; KiTalk may also, after notifying you unilaterally, transfer part or all of the services under this Agreement to a third party for operation or performance. The specific transferee shall be subject to KiTalk's notification.
3. If any of the following Breach of contract occurs, KiTalk may immediately suspend or terminate services to the user and require the user to compensate for losses:
3.1 The user violates the registration obligations in Article IV;
3.2 The user violates relevant laws and regulations or the provisions of this Agreement;
3.3 As required by law or competent authorities;
3.4 For security reasons or other necessary circumstances.
1. The account you register with KiTalk services has password protection function to ensure the security of your basic information. Please keep your account and password information safe.
2. KiTalk strives to take various reasonable physical, electronic, and managerial security measures to protect your information, so that the information and communication content stored in KiTalk will not be leaked, damaged, or lost, including but not limited to SSL, encrypted information storage, and access control for data centers. KiTalk also implements strict management of employees or Outsourced Personnel who may have access to information, including but not limited to implementing different permission controls based on positions, signing confidentiality agreements with them, and monitoring their operations. KiTalk will provide corresponding security measures according to existing technology to protect your information, providing reasonable security Guarantee. KiTalk will always try its best to ensure that your information is not leaked, damaged, or lost, but please also note that there are no absolutely perfect security measures on information networks. Please keep relevant information safe.
3. KiTalk has the right to independently decide the maximum storage period for your data in this software and services, the maximum storage space for data on servers, etc. You shall keep your terminal, account, and password safe and properly Custody of relevant information and content. KiTalk shall not be responsible for data loss or theft caused by your own reasons or the deletion or storage failure of relevant data in this software and services.
1. You understand and agree that unless KiTalk declares otherwise, all intellectual property rights (including but not limited to copyrights, trademarks, patents, trade secrets, etc.) and related rights in all products, technologies, software, programs, data, and other information (including but not limited to text, images, pictures, photos, audio, video, colors, layout design) contained in the services under this Agreement belong to KiTalk or its affiliated companies.
2. You shall ensure that, unless you obtain written authorization from KiTalk, you shall not (and shall not allow any third party to) perform acts including but not limited to leasing, lending, selling, distributing, copying, modifying, reprinting, compiling, publishing, reverse engineering, disassembling, reverse compiling, or otherwise discovering source code, etc. regarding the above rights.
3. The logos, text such as "KiTalk", graphics and their compositions involved in KiTalk services, as well as other identifiers, product and service names of KiTalk are trademarks of KiTalk and its affiliated companies in China and other countries. Users shall not display, use, or otherwise process them in any way without written authorization from KiTalk, nor indicate to others that you have the right to display, use, or otherwise process them.
4. You understand and agree to authorize KiTalk to use your name, trademarks, and logos in Promotion and Marketing, but only to indicate that you are a customer or partner of KiTalk.
1. The services are provided "as is" and "as available". KiTalk Hereby expressly disclaims any express or implied warranties for the Service, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, etc.
2. KiTalk makes no Commitments and Warranties regarding the effectiveness, accuracy, correctness, reliability, quality, stability, completeness, and timeliness of the technologies and information involved in the services.
3. Under no circumstances shall KiTalk be liable for failure or delay in providing services due to Internet connection failures, computer, communication, or other system failures, power failures, strikes, labor disputes, riots, insurrections, disturbances, insufficient productivity or production materials, fires, floods, storms, explosions, force majeure, war, government actions, orders of international or domestic courts, or omissions of third parties.
4. Regardless of foreseeability, and regardless of the form of action, KiTalk shall not be liable for any special, direct, indirect, punitive, incidental, or consequential damages or any other damages (including but not limited to loss of profits or interest, business interruption, loss of data) arising from:
4.1 Use or inability to use the services;
4.2 Costs incurred from purchasing or obtaining any products, samples, data, information, or conducting transactions through the services, or alternative actions to the above;
4.3 Unauthorized access to or modification of data or data transmission;
4.4 Statements or actions made by third parties through the services;
4.5 Other events related to the services, including negligence, resulting damages.
5. You fully understand and agree that, given the particularity of the internet system and environment, the information and personal data you share in the services may be copied, reprinted, tampered with, or used for other illegal purposes by others; you hereby fully acknowledge the existence of such risks and confirm that such risks shall be entirely borne by you. KiTalk shall not bear any responsibility for this.
6. You understand and agree that there may be risks of content or behavior from others including threatening, defamatory, offensive, or illegal content, or infringement of the rights of others (including intellectual property) and anonymous or Impersonation information during the use of the services. Based on the service usage norms described, such risks shall be borne by you. KiTalk shall not bear any responsibility for this.
7. You understand and agree that, like most internet software, this software may be affected by Multiple factors, including but not limited to user reasons, network service quality, and social environment; it may also be subject to various security issues, including but not limited to others illegally using user data for harassment in real life; other software downloaded and installed by users or other websites visited may contain viruses, Trojan horses, or other malicious programs, threatening the information and data security of your terminal device and thereby affecting the normal use of this software. Therefore, you should enhance awareness of information security and personal information protection, pay attention to password protection to avoid losses.
8. You shall not produce, publish, use, or disseminate malicious programs used to steal KiTalk accounts and others' personal information and property.
9. Maintaining software security and normal use is the Joint Responsibility of KiTalk and you. KiTalk will take necessary technical measures reasonably and prudently according to industry standards to protect your terminal device information and data security, but you acknowledge and agree that KiTalk cannot provide a complete guarantee in this regard.
10. In any case, you should not Trust-based Loan, requests for passwords, or other online information involving property. For property-related operations, please always verify the identity of the other party first and regularly pay attention to KiTalk's prompts on preventing Fraud Crime.
1. If KiTalk discovers or receives reports from others that you have violated the terms of this Agreement, KiTalk has the right to delete or block the relevant content at any time without notice and take measures including but not limited to restricting, suspending, or terminating your use of the KiTalk account and services, restricting, suspending, or terminating your use of part or all of the services (including but not limited to deleting contacts, restricting adding members, restricting sending messages or adding friends, etc.), and pursuing legal liabilities.
2. You agree that if any third party makes any claim or request against KiTalk and its affiliated companies due to or resulting from information you upload, transmit, or share through the services, your use of other functions of the services, your violation of this Agreement, or your infringement of any rights of others, or if KiTalk and its affiliated companies suffer any loss as a result, you agree to fully compensate (including but not limited to reasonable attorney fees).
1. Any notice from KiTalk to you may be made by email, public area announcement on the page, personal network area prompts, mobile phone, Text message, or Regular mail, etc. Such notice shall be deemed delivered to or effective on the user from the date of sending.
2. You agree that any notice from you to KiTalk shall be sent to the email,Contact Address, fax number, or other contact information officially published by KiTalk or notified to users by the method described in Article 12.1, or delivered using other methods approved by KiTalk.
1. The interpretation and application of this Agreement, as well as any disputes related to this Agreement, shall be governed by the laws of the People's Republic of China. The place of signing of this Agreement is Pukou District, People's Republic of China. If any dispute or controversy arises between you and KiTalk, it shall first be resolved through friendly negotiation; if negotiation fails, you agree to submit the dispute or controversy to the competent people's court in the place where this Agreement is signed for jurisdiction.
2. If any provision of this Agreement is deemed invalid or unenforceable, that provision may be severed, and the remaining parts shall remain in full force and effect.
3. KiTalk's waiver of rights under this Agreement upon user negligence or Breach shall not be deemed a waiver of its rights regarding other or subsequent similar negligence or Breach of contract by the user.
4. This Agreement shall replace all prior oral and written agreements, arrangements, understandings, and communications between the parties regarding any matter herein.
5. KiTalk has the right to transfer all rights and obligations under this Agreement to its affiliated companies based on business adjustments. The transfer will be notified in the manner specified in this Agreement. User commits to not objecting to this.
